The conditions of Albanian society after 1991 require a new level of change in democratic governance, within the framework of aspirations to join European states. For this reason, it is necessary that any particularly important decision not be taken only by representative bodies, but also directly by the people. In this sense, the law on referendums represents one of the most important institutions of democracy. It gives citizens the opportunity to express themselves directly on major issues. A referendum is a form of popular sovereignty and ensures broader participation of citizens in public life. The draft law “On referendums” deals with the ways, procedures, and cases in which a referendum is held. It defines the entities that may request it, the manner of proclamation, organization, and verification of the result. The relevant articles specify the powers of the Assembly, the Council of Ministers, and other state institutions. Through this law, the aim is to avoid legal gaps and create clear rules for direct decision-making. In this way, the referendum law is seen as an important step in the consolidation of pluralist democracy in Albania.

Kështu është e nevojshme që çdo vendimmarrje me rëndësi të veçantë të mos merret vetëm nga organet përfaqësuese, por edhe drejtpërdrejt nga populli. Në këtë kuptim, ligji mbi referendumin paraqet një nga institucionet më të rëndësishme të demokracisë. Ai u jep qytetarëve mundësinë të shprehen drejtpërdrejt për çështje madhore. Referendumi është formë e sovranitetit popullor dhe garanton pjesëmarrje më të gjerë të qytetarëve në jetën publike. Projektligji “Për referendumin” trajton mënyrat, procedurat dhe rastet kur zhvillohet referendumi. Ai përcakton subjektet që mund ta kërkojnë atë, mënyrën e shpalljes, organizimit dhe verifikimit të rezultatit. Në nenet përkatëse saktësohen kompetencat e Kuvendit, të Këshillit të Ministrave dhe të institucioneve të tjera shtetërore. Përmes këtij ligji synohet të shmangen boshllëqet juridike dhe të krijohen rregulla të qarta për vendimmarrje të drejtpërdrejtë. Në këtë mënyrë, ligji për referendumin shihet si një hap i rëndësishëm në konsolidimin e demokracisë pluraliste në Shqipëri.

Per questo è necessario che ogni decisione di particolare importanza non sia presa solo dagli organi rappresentativi, ma anche direttamente dal popolo. In questo senso, la legge sul referendum rappresenta una delle istituzioni più importanti della democrazia. Essa offre ai cittadini la possibilità di esprimersi direttamente sulle questioni principali. Il referendum è una forma di sovranità popolare e garantisce una partecipazione più ampia dei cittadini alla vita pubblica. Il disegno di legge “Sul referendum” tratta le modalità, le procedure e i casi in cui si svolge un referendum. Definisce i soggetti che possono richiederlo, il modo di proclamazione, organizzazione e verifica del risultato. Nei relativi articoli sono precisate le competenze dell’Assemblea, del Consiglio dei Ministri e di altre istituzioni statali. Con questa legge si mira a evitare vuoti giuridici e a creare regole chiare per il processo decisionale diretto. In questo modo, la legge sul referendum è vista come un passo importante nel consolidamento della democrazia pluralista in Albania.
