“The ministry exceeds its powers” FULL LETTER / THE CHIEF PROSECUTOR “COMPLAINS” TO THE LEGAL COMMISSION The Prosecutor General writes to Fatmir Xhafaj: The inspection of “Justice” in the Berat prosecutor’s office exceeds its powers. The ministry: We have acted according to the law By KLODIANA LALA The Prosecutor General, Adriatik Llalla, comes out against the Minister of Justice, Nasip Naço, over inspections of prosecutors. In a letter sent to the Chairman of the Committee on Legal Affairs, Public Administration and Human Rights, Mr. Fatmir Xhafaj, the head of the central prosecution body stresses that the inspection carried out by the Ministry exceeds the powers granted by the law on the organization and functioning of the prosecution service. “Regarding this inspection report and the conclusions reached, as we have also made known to the Ministry of Justice, and for the information of the President of the Republic, in our response to these conclusions we have expressed and continue to express our position that the inspection carried out by the Ministry of Justice exceeds the powers provided by article 56 of law no. 8737, dated 12.02.2001, ‘On the organization and functioning of the prosecution service in the Republic of ...’ Continues on page 9
