Based on the Constitution of the Republic of Albania, Article 163, point c), and Law No. 154/2014, dated 27/11/2014, “On the organization and functioning of the State Supreme Audit Institution,” Article 10, “Powers,” point e), in accordance with its function, KLSH is competent to control: “the audit of the use and management of funds and public or state property, as well as the protection of the State’s economic and financial interests in legal entities in which the state owns more than half of the shares, or when their loans, credits, and obligations are guaranteed by the state.” Based on the above article, KLSH cannot audit the company “ARMO” sh.a., in which the State has only 15% of the shares, less than half, since 2008. If the members of the Parliament of Albania wish for “ARMO” sh.a. to be audited, they must either approve amendments to the Constitution and the Law, or draft a special law for this case, which would be of great importance and high value for public finances, considering the many bitter cases of abuse of the state’s legal role in joint enterprises where the State holds a minority of shares, which have caused considerable losses to the State Budget and to the interests of citizens.
