Commentary BY AFRIM KRASNIQI One mandate for the next crisis The latest debate over an opposition deputy’s mandate once again brought to the fore the great ease with which Albanian politics plunges into crisis, as well as the double standards in the political reading of the Constitution and legislation. The latest pretext is known: in December 2011, MP Seseri (PS) resigned from her mandate. The Constitution of Albania (Article 71) states that a mandate ends when a member resigns from it. Subsequently, the Electoral Code (Article 164) provides that “the interrupted mandate passes to the next candidate on the list of the same political party in the relevant electoral district,” and “if the next candidate does not appear in Parliament within 30 days of notification, without justified reasons, the mandate passes to the next candidate on the list.” In application of this practice, on 19 January 2012 the CEC announced the decision to grant Ms. Seseri’s mandate to the next candidate on the multi-member list, Gjon Bardhi. The latter, also being the mayor of Fushë Krujë, officially notified the CEC of his refusal of the parliamentary mandate and of continuing his function at the head of the local unit. The CEC did not take a second decision, although legally it was its responsibility to do so (the 30-day refusal deadline), and thus four months later the issue of the opposition’s mandate has become an apple of discord between the majority and the opposition.
