Opinion BY NJAZI JAHO The College and the CEC decision A few days ago I became acquainted with decision number 1 dated 3.1.2013 of the Electoral College at the Tirana Court of Appeal. As is known, this decision is final. Nevertheless, from the legal point of view of the issue, we are also allowed to express a contrary opinion. The Electoral College was set in motion by a lawsuit filed by the Democratic Party, which challenged CEC decision no. 20 dated 21.12.2012 that had not approved the new division of the Electoral Administration Zones for the 2013 parliamentary elections because of the absence of a qualified vote in the decision-making. The plaintiff also requested that the College approve the 100 Electoral Administration Zones, according to the proposal submitted by the Democratic Party. We believe that the above decision lacks the standard of reasoning expected of a judicial decision, while its content is partly contradictory regarding this issue.
