BY NJAZI JAHO Legal obligations toward voters A current issue of particular importance, I think, is the matter of voter lists. Every citizen who has reached the age of 18, even on election day, has the right to vote and to be elected (Article 45 of the Constitution). This fundamental constitutional right is guaranteed if, in accordance with the relevant provisions of the Electoral Code, every voter whose residence is registered in the national civil status register is included in the list of the polling station area. Participation in voting is voluntary, whereas inclusion in the list in accordance with the law is mandatory. Any kind of manipulation with voter lists is punishable. It should be noted that persons charged with preparing and approving the voter lists, when they include false data in these lists or when they leave out voters, are criminally liable under Article 186 of the Criminal Code (see Article 171, point 4 of the Electoral Code).
