During the review in committee, the need to withdraw the state examination for the legal profession and include it as a criterion for obtaining the professional title of lawyer is clearly evident. The committee members, considering that this issue will be part of the regulation under the special law on the state examination for the legal profession, decided not to stipulate in the provisions of this law, as a condition for obtaining the professional title of lawyer, the passing of the state examination for jurists.
Another issue discussed in the Committee concerns whether the suggestion of the EURALIUS mission would be included as a criterion for obtaining the professional title of lawyer, according to which judges and former public officials with decisions by the competent disciplinary body should not be candidates for the title of lawyer. Regarding this suggestion, the Bar Association expressed reservations about this proposal, since the profession of lawyer is a free, self-regulated profession, the exercise of which cannot restrict personal freedom removed from the exercise of office by decision of an administrative body.
