How democracy should function
After months of debate and discussion in the Commission for Drafting the Constitution, the first phase of the constitutional process has concluded.
Albanians now have before them a Draft Constitution, awaiting ratification by their full will. Above all, the draft has sought to shape institutional tendencies within civil society, giving it an apolitical character and avoiding doctrinal fanaticism. The ideas of the totalitarian state have been destructive for Albanian society. Law and morality were expressed through paradox, entirely unlike the Western political tradition, in which society’s ideas are realized through institutional means. The new legislative draft is unacceptable if, with various patches, [it addresses] the shortcomings of the individual. It corresponds to Western constitutional principles, the “Helsinki Agreements” and other international charters. Human rights have been conveyed in such a way as to be apoli-
