“For secrets, journalists get 3 years in jail”

TIRANE - Journalists should not go to prison for defamation. This is what Article 10 of the press and information law passed by Parliament has established. Article 3 prohibits the exercise of criminal sanctioning rights if publications do not violate private life. In special cases, defamation fines cannot exceed 600,000 new lekë for an organization and 250,000 for an individual. The new press law also makes it clear that publishers and journalists will not be responsible for news taken from press agencies. It is learned that the new draft also includes an article prohibiting harm to the image of the president and his family. This is made clearer in the official publication of Parliament, where Article 5 states: “Defamation, insult and other criminal offences committed through the press against the President of the Republic, high state personalities or members of his family shall be punished in accordance with Article 34/1 of the Penal Code.” Article 10 prohibits imprisonment. “For defamation committed through the press and for any other criminal offence committed through the press and punishable under this law, the court cannot impose a prison sentence,” the draft says. Article 3 states: “There is no criminal responsibility for periodic publications that reproduce or broadcast speeches by MPs in the Assembly, court sessions, meetings of local authorities or public lectures.” There is also no criminal responsibility for entities that reproduce acts or documents deposited in public offices or published at meetings of local authorities. Further in this draft it is stated that journalists and editorial offices bear no responsibility for texts sent by agencies, newspapers and national and foreign periodicals. It is also forbidden to record telephone conversations or publish them without the user’s permission. This also applies to facsimiles or any materials taken without the owner’s knowledge. It is also forbidden to describe the way a person was killed or another wounded. This is in order not to use weapons or other effective means to commit further crimes. “The press must not contain writings that incite ethnic, religious or racial hatred or encourage terrorist acts,” the draft says. According to this article, a defamatory piece is punishable by a fine of up to 600,000 new lekë for the organization and 250,000 for the individual, but in special cases the profits resulting from the publication are confiscated. Writings that violate a person’s private life are punishable by a fine of up to 1 million lekë for organizations and 500,000 for the individual. False news is punishable by a fine and 1 year in prison. “Defamation committed through the press against the Republic of Albania and its institutions, with the aim of arousing hatred or contempt toward them, or reducing their authority, is punishable by a fine or imprisonment of up to 3 years,” the draft law states. “Publishing a news item known to be false, through the press or any other means of publication, with the aim of creating a state of anxiety or panic among people, is punishable by a fine or imprisonment of up to one year.” At the end of this draft it is stated that “the publication of news about prisoners or persons in pre-trial detention is prohibited without their consent or that of their families.” On page 3

The protesters from Vlorë also expressed concern that the Minister of Economy did not come to the protest. “The chairman of the Vlorë Committee, the Minister of Finance Arben Malaj, feels offended when the word aid or protest is mentioned,” the letter says. Among other things, the protesters say that the chairman of the aid committee, who for the first time avoided his responsibility during the past 11 months, had promised them that he “would show up and be fair,” but “today, as we are gathering again in protest, he has hidden like an ostrich.” Also, according to the protesters, the Albanian government has not yet created the necessary space to include them in housing schemes. “On the basis of the law, we should have been housed and accommodated by now,” the letter says. Here instead of finding a solution for their housing, the state is expelling them and declaring them illegal. Arben Malaj did not appear yesterday either before the protesters, as he had promised. He had stated that he would cancel his planned trip to Italy and would go meet the residents of Vlorë to promise them a solution. But yesterday Malaj left for Italy. At the same time, his deputy Ilir Frangaj appeared at the protest for two hours. This protest, which has been going on for two months, was postponed with the promise that Beni Malaj would give them 2,500 USD for the tents. Recently they were offered accommodation in dormitories for 4,500 lekë per month. The protesters rejected this solution because it is unaffordable for them. Earlier they had been promised that they would be housed in private homes at state expense or compensated with money to secure alternative housing. So far none of these promises has been fulfilled. Yesterday the protest was also supported by MP Azem Hajdari, who promised the tent dwellers that he would soon open a foundation to build their homes.
