By THIMI SAMARXHIU It often happens that court decisions contain slips or minor mistakes, but until now it had never happened that a person under investigation was attributed with committing a murder. This happened only a few days ago in the Tirana Court of Appeal’s decision on replacing the security measure for the former Commander of the Guard, Ndrea Prendi, where Judge Hysni Demiraj, in the written-out decision, argued that the material received from the FBI proved that the bullet that killed Aleks Nikaj was fired from Prendi’s gun, at a time when the Prosecutor’s Office had accused him only of the murder of Faik Myrtaj. In the ruling of 22.02.2012 on replacing the security measure for Ndrea Prendi, the Criminal College of the Tirana Court of Appeal, led by Judge Hysni Demiraj, reasoned as follows: “It results that they are...
