The recommendations drafted by the OPDAT mission of the U.S. Department of Justice also suggest that participation in training organized by military or paramilitary organizations involved in an armed conflict be criminalized. Another recommendation is the restructuring of the articles so that the situations of exemption from criminal liability are listed separately and are clearer. “We believe it is essential to make it clearer that the person must, at the same time, be a citizen of a foreign state that is in conflict and an official member of the armed forces of that state, in order to be exempt from criminal liability.
