Comment BY FEHMI ABDIU* The President and the resolution of crises Previously we stressed that the President of the Republic does not belong to any of the three branches of power, but to this conclusion, already known to everyone, we can add the argument that he serves as an important factor in avoiding political crises, or that the caution exercised is the price paid to prevent them. In such special situations, it seems that two powers are balanced, the legislature and the executive, and when they consume the necessary procedures without positive results, the authority of the President emerges, in the quality of a roaming factor. 1 - We find this idea best reflected in Article 96, paragraphs 2 and 3 of the Constitution. Initially, at the beginning of the legislature or at any time during it, if the post of Prime Minister is vacant, the President is obliged to appoint one with the approval of the party or coalition of parties that holds the majority of seats in the Assembly. Unlike this obligation, in the situation where the appointed Prime Minister is not approved by the Assembly, the President appoints a new Prime Minister within a 10-day period. In such cases, which have not been encountered in our parliamentary practice, his figure stands out as a key figure who takes on the task of avoiding the crisis by appointing as Prime Minister a candidacy that theoretically may belong to the majority, but may not have been proposed by it, just as it may belong to the opposition or even to a person who belongs to no party.
