News The European Court of Human Rights in Strasbourg yesterday ordered the Albanian state to pay 3 million euros in compensation to four families that had filed property claims. At the same time, it announced a 18-month suspension of the examination of new Albanian property cases, while cases already submitted will continue along the normal path.

Press Release Issued by the Registrar of the Court ECHR 317 (2012) 31.07.2012 EUROPEAN COURT OF HUMAN RIGHTS COUR EUROPÉENNE DES DROITS DE L'HOMME Pilot judgment concerning non-enforcement of administrative decisions awarding compensation for property confiscated under the communist regime in Albania In today's Chamber judgment in the case of Manushaqe Puto and others v. Albania (applications nos. 604/07, 43628/07, 46684/07 and 34770/09), which is final, the Court held, unanimously, that there had been: a violation of Article 6 § 1 (right to a fair hearing) of the European Convention on Human Rights; a violation of Article 1 of Protocol No. 1 (protection of property); and, a violation of Article 13 (right to an effective remedy). The Court considered that the numerous problems at the root of the violation could be traced to a dysfunction in the national legal order. It therefore required Albania to set up, within 18 months, an effective compensation mechanism. As regards the procedure to be followed in similar cases, the Court decided to adjourn the proceedings concerning all new complaints against Albania, lodged with it after the delivery of this judgment, in which the applicants raised arguable complaints that primarily derive from the prolonged non-enforcement of final property decisions. That adjournment will solely be for a period of 18 months after today's judgment becomes final. The examination of similar cases lodged before the delivery of today's judgment will continue.
