ZEF PRECI FATMIR MEMAJ Fiscal procedures versus business Fiscal administration and policies are considered highly important in the current situation of businesses in Albania, given the fact that administrative procedures are among the most challenging aspects of daily business activity. Businesses face a relatively large and frequent number of inspections carried out by the tax administration. In addition, in some cases the tax authorities do not comply with the law regarding the notice they must give private companies 24 hours before an inspection. There are cases where the same activity is subjected to several consecutive inspections. The reduction in the number of inspections carried out by tax inspectors each year, and even the tax bodies themselves, must respect the law by sending notice 24 hours before companies are inspected. During inspections, inspectors should carry out only operations that are the subject of the latest inspection. The same business activities should not be subject to several consecutive inspections. In order to avoid unfair procedures, the regulation concerning the responsibility of businesses for verification must be fully respected. A prior determination of the administrative procedures necessary for inspection should be made, starting from inspection visit programs, authorization, duration, and they should be organized in accordance with a risk-based approach.
