However, according to the court, the evidence submitted by the prosecution is weak TIRANA ARBEN RROZHANI The Court of First Instance in Tirana, through Judge Shkëlqim Mustafa, on Sunday decided to reject the prison arrest measures for the former commander of the Guard Ndrea Prendi, his former driver Margarit Kume, and the former IT specialist at the Prime Minister’s Office Armando Kasaj. In its ruling, the court described the request of the Tirana Prosecutor’s Office as indirect, stating that for any Guard employee who was assigned to protect the Prime Minister’s Office building, there can be no criminal offense of murder, as long as he was carrying out military duty and the consequences may have arisen from exceeding or failing to properly apply the rules for guarding this facility by the Republic Guard. According to the court, the Guard can be accused only of violating the rules of guard service at important facilities. On the other hand... Editorial BY ARBEN RROZHANI The government’s last move The Tirana court, within the span of one year, imitated an action that had many consequences for Albania’s democratic standards. While one year earlier, after the massacre of 21 January 2011, the State Police did not execute the orders to stop the command office of the Republic Guard, leaving the suspects for murder and injury free, two days ago the court decided to leave at their homes two members of the Guard and an IT specialist at the Prime Minister’s Office. In its reasoning, the prosecution, relying on the evidence and conclusions brought by the FBI, accused the three officials of murder and tampering with evidence. The former commander of the Guard was accused of being the killer of one of the demonstrators, and in order to escape the crime he had manipulated the pistol-type weapon to pin the murder on his driver, who that day was not even at the scene. Meanwhile, the IT specialist at the Prime Minister’s Office is responsible for the deletions from the Prime Minister’s Office server that had collected the video footage from 7 cameras showing the killings and the killers, leaving only those that showed protesters attacking the police and the Guard. ...in the court’s reasoning it is not hard to read the defense made by Sali Berisha...
