The Ministry of Energy and Industry, in its capacity as Contracting Authority, is to take measures to enforce the contract guarantee in the form of a bank deposit in the amount of 4 million euro, as a contractual obligation of the concession company “BEG SPA”, which, in implementation of the deposit, in violation of Article 15.3 of the concession contract in the “BOT” form, concluded between METE and the concession company “BEG SPA” for the construction of the Kalivaç hydropower plant, approved and amended several times by Council of Ministers Decision No. 222, dated 24.05.1997, published in the Official Gazette No. 19 of June 2000, amended by Council of Ministers Decision No. 590, dated 02.11.2000, published in the Official Gazette No. 36, dated 15.11.2000, and Council of Ministers Decision No. 363, dated 06.06.2007, not published in the Official Gazette. 10. The Ministry of Energy and Industry, in its capacity as Contracting Authority, is to take all measures so that, on the part of the concession company “BEG SPA”, the subscribed capital of 4 million euro is fully paid in, in implementation of Article 13 of the signed concession agreement, which states: “The concessionaire, upon the establishment of the new company, is obliged to transfer to this company the rights of the concession agreement and to own 80% of the direct or indirect participation in the company controlled by the concessionaire and the rest of the share capital. This company shall have a minimum capital of 15,000,000 euro”. Immediately D.2. The Department of Public Administration is to be notified regarding the former Secretary General’s departure from the ministry, Mr. Dardan Domi, who was dismissed from work because he concealed the disciplinary measure of “dismissal from the civil service”, pursuant to the civil service legislation in force. Through his actions and omissions in carrying out the assigned duty, he caused a failure in results due to the lack of cooperation with the representatives of the High State Audit and the blocking of audit actions, in order to prevent the truth from coming to light, the serious state of the situation which for years has blocked the minister and MP Mr. Florion Mima.
