On 6 November the people will say NO to the illegal violations that aim to restore the dictatorial power of one individual and one party. Neither bans, arrests nor seizures will break the Socialists! Even though yesterday the police seized 250,000 propaganda leaflets of the PS, its message will reach every home

The information and the alarming reports circulating confirm that in several places in the country the illegal campaign against the Socialists is being dragged out. This is a primitive behavior and a dangerous anti-democratic process in Albanian political life. DECLARATION of the Presidency of the Socialist Party Information and various reports coming from different centers of the country show that an illegal, dishonest and primitive campaign has been ordered against the Socialist Party and its members. The instigators, organizers and executors of this campaign are high-ranking officials of the Albanian state. The entire apparatus of violence has been engaged, especially the courts and the state police. Such irresponsible and anti-democratic acts have reached such a level of escalation that: some PS organizations have been unlawfully and brutally dissolved, many of its activists and members have been arrested and detained, citizens have been terrorized, 250 thousand campaign leaflets have been seized and withheld, etc. These actions constitute a flagrant violation of constitutional rights, recognized international standards and Albanian legislation. They lead to the destruction of the climate of political understanding and of a free and symmetrical electoral competition among political forces, created for the first time in our country. The fact that these actions are being taken against the largest opposition force in the country and at the height of the electoral confrontation over the constitutional referendum, we regard as a fully political act directed against political opponents and as an attempt to create tension, perhaps even to provoke incidents before and during the vote. All these practices are worthy of totalitarian and dictatorial states and not of democratic countries. They are clear evidence of the methods and means by which the country’s president seeks to achieve his aims. The Presidency of the Socialist Party declares that it is determined to pursue, with high political responsibility and in a democratic manner, its path to oppose this dangerous climate and these extremely harmful acts. These processes constitute a serious threat to social peace, order and democratic stability in the country. (Continues on page 2 )

While in yesterday morning’s first newspaper “Koha jonë” a greeting from the President of the Republic to the Macedonian people was published, on the same page the well-known poet and academic Ali Podrimja was telling Albanians that they would do themselves great harm if they did not reject the draft constitution. And in this first response from their Albanian League, the well-known poet and journalist Dritëro Agolli took up the word and gave the Socialists hope that the Albanian people will answer “No” on 6 November, the day of the vote on the Constitution. In his letter addressed to the President of the Republic, Lirbohsha addresses Berisha, expressing appreciation for the support he has given to the Kosovo issue, but he formally advises him that “we would be astonished and would feel bad if the Albanians of Albania accepted the new Constitution by voting for it, because it would be as if a new act of self-criticism.” ( Continues on page 2 )

PROTEST Regarding the banning of the leaflet and its mass seizure by the public police on 28 October 1994, the following statement is issued: The distribution of a printed item is prohibited and its blocking is ordered in the name of a “verbal order” from a police director general. This act constitutes a flagrant violation of the legal order and an arbitrary act by the police. The blocking was done for political reasons and not for reasons of public order. Under these conditions, we urgently request the relevant institutions to immediately restore the rule of law and punish the authors of this violation. ( Continues on page 3 )

- Interview with PS deputy chairman Ylli Bufi given to “MIMI DOKLE” - The final conclusion of the Council of Europe delegation and the institution’s reports in Strasbourg was that the expression “Assembly Constitution” belongs to the Constituent Assembly and not to Parliament. Nor did the question about a constitutional referendum and not about a draft constitution turn out to be incompatible with the Venice Commission’s statement, nor with the word “no”. Question: How is it possible that in such a heated electoral situation you put a question, “Assembly Constitution,” and talk only about its support? How should this issue be understood? Ylli Bufi: That is not true. The statement of the Venice Commission and the Council of Europe has assessed this as a matter of procedure and not of substance. By decree no. 1240 dated 20.10.1994, the President of the Republic has set Sunday, 6 November 1994, as the date for the referendum on the draft Constitution, and by decree no. 1241 dated 20.10.1994 he has assigned this institution the task of organizing the referendum and the local elections. This is contrary to the laws in force, because only by law can the date of the referendum be set and the institutions responsible for organizing it be designated. (continues on page 6 )
