Three members of the Constitutional Court resign

Three members of the Constitutional Court resign Members of the Constitutional Court, Andi Koçani, Ilir Myrto and Enver Omari, have requested resignation from their functions as judges of the Constitutional Court. In the letter sent to the president of this court and to the President of the Republic, the resigning members state that the reason for their departure is "the lack of independence of the institution". The resignation of the three judges of the Constitutional Court has sparked different reactions in legal circles, but it has also created great concern because, in the current circumstances, this constitutional court needs functional stability more than ever. This is the assessment of a number of jurists with whom the newspaper spoke. "As far as this constitutional court has gone, no act of its can be found that is unconstitutional or undemocratic. The creation of such a precedent is not only unconstitutional, but also unprecedented for the country's legal standards," said Anastas Angjeli, professor at the Faculty of Law of the University of Tirana and at the same time professor of constitutional law. According to Mr. Angjeli, the departure of the three members of the Constitutional Court, besides creating a dangerous precedent in the legal sphere, also constitutes a condemnable act in political terms. "The departure of the three members of the Constitutional Court at this delicate moment, when the constitutionality of the referendum on the draft constitution is expected to be judged, leaves room for suspicions whether we are not dealing with a staged pressure intended to give the authorities the chance to bring in some conformist judges to this body," says Mr. Angjeli. A similar assessment regarding the resignation of the three members of the Constitutional Court was also made by the well-known lawyer Spartak Ngjela. SKËNDER HUSENI: "The collapse of the institutions' credibility in this country has come as a result of the deformities and pollution of the legal system in Albania, and the fall of this court to this level cannot be accidental." He also made it known that the Constitutional Court cannot allow the fate of the referendum on the draft constitution to remain in the hands of government offices. PETRIT TAHMAZIJA: "In this incident there is not a single line about the matter of national dismissal." BASHKIM KOPI: "The confusion created by the resignations belongs, secondarily, to the institution of the referendum and political law." According to the President's office, no decision has been taken for unacceptable interference.
