The Plenum of the Court of Cassation before the Constitutional Court

Nano has no option but to seek protection of legality in the Tirana Court. On 18 September, the Plenum of the Court of Cassation will be definitively dissolved. At 10:00 on that date, a hearing will be held at the Constitutional Court to make this fact lawful. The request was submitted by the Council of Ministers because it was necessitated by the entry into force of the new Criminal Code on 1 July 1995, which stipulates that protection of legality is no longer provided by a Plenum of the Court of Cassation, but by the first-instance court where the judicial proceedings began. In yesterday’s letter [text cut off] 18 September 1995, a representative of this court is to be present to attend the hearing. The hearing will be held pursuant to the lawsuit filed by the Council of Ministers, also concerning the Court of Cassation’s initiative to continue the Plenum of 26 July 1995 in the Nano case. The Council of Ministers is suing the Court of Cassation, arguing that the Plenum scheduled to be held at this institution on 20 September 1995 in the Nano case is illegal. Parliament must not be an arena for futile quarrels

Honorable Speaker, Honorable Members of Parliament, I wish the Assembly success in its work on the occasion of the opening of the 8th Session of this legislature. I agree with the People’s Assembly’s work program for these two months, September–October. We began this session amid great political tension. This is to the detriment of the Nation. Signs indicate that the level of party warfare in Parliament will increase in the future. This must not be allowed. Parliament is not, and must not be, an arena for party warfare and futile quarrels. Nor an arena for journalistic clamor. The support expressed by the Chairman of the Presidium of the Assembly, Mr. P. Arbnori, for the Intellectual Forum against communist genocide, is among the best things he put forward today in his opening address for the Session. I disagree with the statement by an SP deputy, who today called the intellectuals’ declaration “A surrogate declaration by unknown intellectuals.” The Forum in question is made up of intellectuals from Continued on p. 3 Address by Prof. Dr. M. Çeliku, PR deputy, delivered in Parliament on 8.09.1995, and the approval of the work program for the period September 7–October 30, ’95 Now the SP government officials have understood that we have set ourselves the task of curbing excesses. We will begin by establishing a truly independent judicial system. For two years, 23 politicians have been driving us crazy with interviews, opinions, comments, analyses, and reflections on Leninism set out in newspaper pages. With the new draft law, the number of these politicians will be reduced to a single digit. by establishing a truly independent judicial system. The SP has also been reformed politically. The slogan “Glory to Marxism-Leninism” has been replaced by the slogan “Glory to Marx.” I have been, and remain, of the opinion that Albania does not need people who respect the laws. As Law 144 also put it, “I am the law.” Times have changed. It is no longer as it once was, when the prosecutor and judge brought criminal charges. Now free citizens and, to a somewhat lesser extent, politicians, take prosecutors, judges, and lawyers to court. This is gramin e vet ekonomik. This is in keeping with the purpose of Q'është ky kapitalizëm i madh që i kemi vënë vetes për shfrenuar. Tirani

The second round of court proceedings over the show’s “Benci”

Its two claimants will face off while “Benci” is impounded The “Benci,” the 12-million prize won through the lottery on the show “12 Dances Without a Saturday” by Mimoza Dervishi, a young woman from Kuçova, is appearing in court for the fifth time. Having completed a full cycle of trials in the three levels of our courts, it has begun the second cycle again and tomorrow it will be before the Tirana Court of Appeal. Fatmir Dumica, a young man from Pogradec, is suing the winner for the fifth time, because he too was announced as the winner of a ticket, but it was considered a computer error. Nevertheless, the “golden Benci,” as it has been called, whose cost including court expenses is estimated to have reached 15 million, has been impounded for 20 days at the Durrës police station, because the father of the girl from Kuçova was driving it in that city without a license plate. In any case, everything will be decided definitively between the claimants. B. P.
