Since yesterday, prisoner No. 975 has 3 years, 3 months and 11 days as well. This prison term was made legal for him by the deputy chairman of the court, Zef Nika, in the decision handed down yesterday in this court.
The judicial council of the Criminal Cassation Chamber overturned the decision of the Tirana Court of Appeal and adhered point by point to the request of prosecutor Gani Dizdari, who had been appointed only a few days earlier as deputy prosecutor general of the Republic. Thus the history of the first trial, which began on 3.04.1994 when Fatos Nano was sentenced to 12 years in prison by the Tirana Court, even though it was approaching the conclusion of the eighth hearing, has returned to its "origin": exactly what prosecutor Arben Qeleshi had requested.
The judicial council of the Criminal Cassation Chamber argued that Nano cannot benefit from the provisions of the New Penal Code, since he was convicted of two criminal offenses: 10 years for theft of state property in large amounts accompanied by abuse of office, and 3 years for falsification of official documents, which, through the merging of sentences, was calculated as 12 years in prison.
The entry into force of the New Code on 31.06.1995 leaves in force the decision of the Tirana Court of 3.04.1994. The Court of Cassation also clarified once again that the requalification of the criminal offenses from the articles of the old Code to the New Code by the Tepelenë Court on 19.07.1995 is entirely correct. The prison administration has also calculated without error the time Nano will remain in prison and all the concessions he has benefited from amnesties and presidential pardons. If until yesterday Nano had 2 years, 3 months and 11 days left to serve, as of today he has 3 years, 3 months and 11 days left.

A provocation that fuels political tension
Kuçovë: The PS chairman prevents the PR activity from taking place
PS chairman: "I will not allow Fatos Nano to be insulted in the Town Hall hall"
On 28 November 1995, the meeting of the Steering Council of the PR branch for the district was to be held in the town of Kuçovë. The chairman of PRSH, Mr. Sabri Godo, was also to take part in this event.
The meeting was scheduled to take place in the town hall, a normal practice for the activities of political forces in the district. But the local leaders of the PS, at the last moment, did not allow the PR event to be held in the municipality’s premises.
The PS chairman for Kuçovë, Mr. Fatbardh Islami, told PR representatives that he "...would never allow Sabri Godo to insult Fatos Nano in the hall of the Kuçovë town hall by calling him a thief". Mr. Islami demanded that "...if the republicans tried to hold their meeting, he would forcibly throw the chairs out of the hall". Under these conditions, the district PR leaders were forced to urgently improvise another venue to carry out their activity.
Regarding the reason for the socialists’ obstruction of the meeting, Mr. Sabri Godo declared that "justice is not established by insulting and killing people, nor by holding rallies in the street. In a democracy, the law must function, and the only institution that declares a citizen guilty is the court".
The PR spokesperson strongly protests against this intolerant and prejudiced act by the PS chairman of Kuçovë. He considers it a provocation that fuels political tension in the conditions of an extremely heated pre-election situation. PR has always taken, and continues to take, an opposing stance to such actions to the detriment of political forces. It will also in the future maintain its position toward anyone who creates political precedents.
This is not the first time that PR activities have been met with provocation. Several times PR representatives have been put in a difficult position. On one occasion, at a meeting of the PR chairman with the people of the Pojan commune in Korçë, two socialist individuals even threatened Mr. Godo.
In any case, PR did not make a fuss, not wanting to present itself as a victim. But the stance of the PS chairman of Kuçovë makes us consider it a directive coming from the center.
The PRSH spokesperson, Neritan Allibali, states that in the event of such acts being repeated, PR will hold the higher PS leadership bodies responsible.
He also states with full responsibility that no PR member has attempted to disrupt the activities of others, but on the other hand PR will not allow anyone to interfere in its activities either.
