The state - a monopoly over smuggling
Tomorrow Parliament will examine the Government's draft law on establishing a commission and its functioning in the fight against smuggling and corruption.
As Deputy Prime Minister Fino, who has been appointed chairman of this commission, has announced in advance, in order to minimize smuggling, every police officer who catches smugglers will receive 40% of the value of the goods that are seized. Also, legal procedures will be shortened to 48 hours, down from the 15 days that had applied previously.
Although the fight against smuggling and corruption in general is an undertaking that should be welcomed, it is clear that everything is being done for propaganda reasons. Smuggling cannot be stopped by a weak state, and even less by a state that calculates its own survival on the results of smuggling. How can smuggling be curbed in a country where terrorist acts occur every day? Anti-human smuggling, organized crime carried out by mafia groups that have penetrated the structures of the state. The crime of smuggling, which is at the "top of the mountain" with society beyond citizens, develops according to a perfect procedure, involving resources, weapons, non-ferrous metals, drugs, smugglers and prostitution. This mining network includes those who corrupt the police, customs officers, drivers, shëtitësit and criminal networks.
Documents are signed by high-ranking officials in exchange for maximum profits. The network has expanded internationally. Even ordinary staff have worked closely with law-enforcement bodies on both shores. Several ministers have been appointed to the anti-smuggling commission, but not specialists. The Constitutional Court's decision has pushed the situation into a new crisis, where a clash between institutions could have dangerous consequences.
This Court, by judging constitutional laws, regardless of the political purpose recently expressed by Parliament in this matter, once again underscores this court's stance above every other body, which makes its decisions untouchable and creates serious problems.
On the other hand, the desire and haste of today's rulers to force the rotation of this court by changing the Constitutional Law is a clear expression of the intent to move it from the political control of the PD to the political control of the PS. The call for the dissolution of this Court is a tendency to disregard institutions and laws.
It is not right for any political bias to play with institutions or constitutional laws; this brings only anarchy and political absolutism.
The Republican Party believes that the unification of the Constitutional Court with the Court of Cassation should be carried out through normal constitutional procedures, and this should also be provided for in the new draft Constitution.
