TIRANA — The institution is in complete confusion. The situation that has arisen in the justice system has had such consequences for the prosecution bodies and the Court of Cassation that the normal continuation of work has now become almost impossible. The reason is still linked to the criminal case against the former Prosecutor General Maks Haxhia, which could lead to many cases being reopened again. If that happens, then the lawsuits or convictions handed down by the above bodies will be considered invalid. In this context, a reorganization of both of these bodies would undoubtedly be necessary. But will this really happen?
According to our sources close to the Court of Cassation, yesterday Parliament approved the resignation of the member of this court, Eduard Hado, who had asked to leave on health grounds. Mr. Hado, in fact, had been opposed as a name by the President of the Court of Cassation, Zef Brozi. According to Brozi, Hado began his career on 11 January 1991 at the head of the Durrës Court, later moving on to the highest court. During the period of his arrival in Tirana, the first signs of what Mr. Brozi calls irregular actions began to appear. "I expressed a negative opinion about Hado because I have constantly had complaints against him," he said.
In fact, the paradox was that the head of the Court of Cassation had requested Hado’s removal even before the Haxhia case was reopened. He also submitted a report asking Parliament to remove him from office. However, at that time this institution rejected Brozi’s request. In any case, the president of the court would have agreed to the removal of a person against whom, in his view, investigations would begin. "I, - he said before the deputies, - will submit materials to Parliament on three cases of corruption in the courts."
According to Brozi, various judges have taken bribes to change decisions. Some of the accusations are related to district courts and the way the system functions. He hinted that the verification process will be expanded and that Parliament must intervene to cleanse the judiciary.
On the other hand, Hado’s resignation has been interpreted as an important development for the restructuring of the Court of Cassation. The crisis that has been created has led to numerous debates, and the coming days are expected to clarify whether there will be further departures or reassessments of previous decisions.
