A new trial is requested MYSTERY Farra makes another denunciation “The file of the 1 million dollars disappears” CARLO BOLLINO TIRANA — “For a year and a half they have been trying, by every means, to bury the file of a scandal of huge and unusual proportions. To steal 1 million dollars from the state coffers without taking a single penny out of one’s own pocket — that is what has been done in Albania to the detriment of the central bank. Denouncing such a scandal for the first time in Albania with proof can be fatal.” With these words, yesterday the former chairman of the State Control Commission, Mr. Jorgji Farra, began for the second time his unusual battle to convince Albanian justice not to archive a financial scandal of unprecedented proportions. Farra began his protest in the courtroom, against the state attorney, against the prosecutor, against the central bank and against the judge of the first hearing, whom he accuses of having favored, on 21 July 1993, a lawsuit he filed against the Paper Factory in Kavajë and the persons charged with responsibility for the non-payment of a promissory note worth 970,000 dollars. At yesterday’s hearing, which ended with a postponement to 26 December, the central bank’s defense lawyer, Prof. Anastas Angjeli, asked for the case to be dismissed, recalling that the same matter judged on 21 July 1993 had already been definitively ruled upon. This request was also accepted by the chief prosecutor of the Civil Court in Tirana. But according to Farra, at the first hearing (the facsimile of the ruling, published today here by "Gazeta Shqiptare") his opposing party had not even appeared. "No second hearing was requested for the postponement of the case, - says Farra, - but Judge Liço Xhuvani not only interrupted the trial, he also decided not to accept the lawsuit and to throw it out, something that never happens in judicial practice." Farra holds responsible for this backstage maneuver not only Judge Xhuvani, but also the central bank and the Paper Factory of Kavajë. "Between the payment of a maturity installment on 26 promissory notes on 1 June 1991, the Paper Factory’s lawyer notified in writing that the Albanian enterprise no longer owed this commercial debt to the state bank because of a private agreement previously reached with the Italian foreign entity. On 21 July 1993, on the other hand, the Paper Factory’s lawyer said in court that he had no knowledge that such a notice existed. How is it possible that an officially sent notice in 1991 was no longer found in the plaintiff’s file? Who removed it?" Farra asks. The file of the first trial has become inaccessible since yesterday. "Not only has the notice disappeared, but it seems the entire file has vanished. We still hope to find it, but even if this file no longer exists, we can prove in court that the decision was taken unjustly," Farra told "Gazeta Shqiptare" last night. The REC currently extends its activities in Albania. Therefore the REC office is following full-time position, starting February 1, 1994. The applicant should be able to represent the REC in Albania to manage the local GRams Program and to set up a new local office in Tirana. Program tasks and responsibilities: - coordinating and organising local seminars and press conferences based on the current local work program and local initiatives - handling requests about REC services; - assisting and supporting communications among donor organisations, - assisting NGOs in writing project proposals - managing and reporting projects of local Grants Program, - reporting to the Regional Director of the REC Budapest. For this position the following requirements have to be met: - Good knowledge of environmental NGO community in Albania; - Good knowledge of environmental situation; - Good knowledge of English and of local language; - Ability to work independently; - Planning; - Good organisational and managerial skills. Until the opening of an office, or more (possibly in second half of 1994), is required to work from home or existing office, to secure permanent communication with REC Budapest office and to collect information and project documentation. The REC will provide a salary & training to the person according with the job description given. The person will be given accounting by local job classification in Albania, according to the recommendation. Mr. Farra says that yesterday he formally submitted the complaint to the president of the Supreme Court, who also confirmed its receipt (78.361 prot., dated 7 December 1994). Since on appeal there was the old representative (not the president himself), we had learned then, but other sources confirmed to "Gazeta Shqiptare" that the complaint had been registered by protocol decision. This means that on Monday, 12 December 1994, the case will either be examined definitively or sent to the Court of Appeal. In any case, the postponement to 26 December creates a strange situation. If the rules of justice are respected, the hearing should have been suspended immediately. If the rules are not respected, the case would be handled according to the first-instance court decision, which according to Farra did not legally exist. The risk is that the story of the 1 million dollars will drag on until all traces are completely lost. Durrës
