TIRANA - At a special meeting yesterday, the government approved the draft law “On the Protection of Competition”, which aims to create the necessary conditions for a market economy, but at the same time also to protect consumers and their interests.
The draft law sets out the rules to be followed by state bodies in this field, as well as the bodies that will act to enforce it. Noteworthy is the creation of a Competition Committee with the right of appeal to a special court against the decisions of this committee.
The draft law prohibits any activity by enterprises that harms competition, such as limiting or controlling production, dividing markets or supply sources, applying different conditions to the same transactions with other trading partners, placing them in an unfavorable competitive position.
Likewise, a dominant position in the market is prohibited, a position that any enterprise holding more than 40 percent of the market will have, unless proven otherwise. Market dominance is prohibited, for example through setting unfair prices or other unfair trading conditions, restricting production, markets or technical development to the detriment of consumers, applying different conditions to the same transactions with other trading partners, placing them in an unfavorable competitive position, or making acceptance of contracts by other parties conditional on their acceptance of additional obligations which, by nature or according to commercial usage, are not related to the subject of the contract.
The competent body for the protection of competition will be the Competition Committee, which will consist of 7 members, appointed by the Assembly on the proposal of the Council of Ministers. This task is assigned to lawyers and economists with more than ten years of experience, while the powers of this committee extend to price control in the event of a monopoly and approval of economic concentrations between enterprises.
