On the surface, the conflict appears to concern legal powers and jurisdiction, but in fact it is quite likely that, whatever its legal form, the conflict may be political. Although it is not exactly known what the President’s objection was in the moments before the decrees, his action regarding the latest law on the structure of the Government makes it clear that something is wrong. The first question that arises is: does the President have the right to reject the Prime Minister’s requests to renew the Government? It would resolve the government crisis, but only through the Prime Minister’s legal move. So what is the way forward? The Prime Minister is obliged to resign, followed by his own party, which is the party of the majority. After that, the President is obliged to appoint him by decree as Prime Minister, and he must then, within the constitutional deadline, present his government to the President and Parliament for a vote of confidence. In such a case, it would be impossible for the President to find legal grounds to refuse to appoint the ministers by decree, because once the President has appointed the Prime Minister by decree, appointing the government by decree is mandatory; otherwise, it would be an attack by the President on the Constitution, an act that would entitle Parliament to dismiss the President. the Government? This is because, if the Prime Minister seeks to renew the Government by dismissing ministers, this is necessarily subject to presidential approval. But Western practice, which has dealt with such situations, has resolved this issue clearly. First, any government change made without the resignation of the minister concerned is considered a government crisis. Precisely for this reason, it should not be the President’s will that ... the Prime Minister’s decree by the President is mandatory, because otherwise it would amount to an attack by the President against the Constitution, an act that would give Parliament the right to dismiss the President. But it seems Albanian politics still does not wish to proceed according to precedents and practices established by the politics of the Western democratic states. For this reason, we find ourselves in such situations, which at times follow an absurd legal course and force the Prime Minister to govern outside the frameworks he envisages as successful for conducting his policy of governance. The Government-President conflict, understood to have occurred on this day, cannot find a solution because the Prime Minister himself has not followed the route of circumventing the President’s powers.
