REPUBLIC OF ALBANIA
PEOPLE'S ASSEMBLY
LAW
ON AMNESTY
ON THE OCCASION OF THE 50TH ANNIVERSARY OF THE LIBERATION OF THE HOMELAND
FROM THE NAZI-FASCIST OCCUPIERS
proposed by the deputies
of the parliamentary group of the Democratic Party
6 November 1994-2.12.1991
For a series of articles of the Penal Code
the court imposes prison sentences ranging from
ARTICLE 1
a) 5 and a half years to 16
years in prison and confiscation of property
b) 4 and a half years to 14
years in prison and confiscation of property
c) 5 years to 12 years in prison and
confiscation of property.
All persons sentenced to imprisonment by
military personnel for the offense provided for in Article 19
of the Military Penal Code are granted amnesty.
ARTICLE 2
Those sentenced for illegal possession of weapons do not benefit from this amnesty
a) when the criminal offense committed was committed a second time intentionally
b) in both cases the convicted persons are military personnel
convicted on the basis of Articles 68
of the Penal Code, 47 and 48,
and Article 32 of the Military Penal Code.
ARTICLE 3
All persons sentenced to up to 3 years in prison
for the offenses provided for in
Chapter 13 of the Penal Code are granted amnesty, and
those convicted of crimes against the state
who at the time of committing the offense
were under 18 years of age.
ARTICLE 4
Four convicted persons are granted amnesty from
all suspended sentences imposed by
military personnel.
ARTICLE 5
All persons convicted of abandonment
of the country (Article 47 of the Penal Code),
as well as those convicted under criminal proceedings
of that article, are also granted conditional amnesty.
ARTICLE 6
A 6-month
reduction of imprisonment or reduction of the sentence is granted to persons convicted on the basis
of Articles 47 and 48 of the Penal Code,
those sentenced to imprisonment of up to 2 years
ARTICLE 7
For certain articles of this law
the court will order the release of the convicted persons
or a reduction of the sentence.
ARTICLE 8
The Ministry
of Justice, the Prosecutor General's Office and
the Ministry of Public Order
are responsible for implementing this law.

THE NATIONAL QUESTION
ALBANIAN FREEDOM FIGHT
ANTI-FASCIST LIBERATION
The Institute of History in Tirana
and the Institute of Albanian History in Shkodër
organized a scientific session dedicated to
the Liberation War.
The session was chaired by
Prof. Dr. Aleks Buda.
Reports were presented by Prof. Dr. Luan Omari,
Prof. Dr. Kristo Frashëri,
Aleksandër Meksi and Ylli Popa.
The papers emphasized the national
character of the war and its role
in consolidating the Albanian state.
It was also pointed out that
this war cannot be used
for narrow political purposes.
Most of the speakers underlined
that 29 November remains a date
of historical importance, but also an
occasion for civic reflection.

Also present at this meeting were
personalities from culture,
science and the arts.
At the end, the participants approved
a greeting addressed to
the chairman of the PD, Dr. Sali Berisha.

"The amnesty law represents a high
civilizing gesture and an
expression of the humanism of the
democratic state," said one of the
deputies in the parliamentary session.
According to the speakers, this initiative
marks a step forward in bringing
Albanian legislation closer to European
standards and in strengthening citizens’ trust
in institutions.
Some speakers linked the amnesty with
the need for social reconciliation after
years of tension and transition.
Others underlined that partial forgiveness
does not undermine justice, but rather
completes it with a human dimension.

Albanian citizens are being
repeatedly returned by the Greek side at the border point
of Kapshtica. According to local
sources, some of them have been returned
for lack of documents,
while others for reasons related
to changes in crossing rules.
Residents of the area call this situation
worrying, as it affects
entire families and creates ongoing insecurity
for emigrants.

The Prime Minister of the state of Israel, Yitzhak Rabin, was also informed, as were
Prime Minister Alfred Sant of Malta,
as well as Romanian President Ion Iliescu,
and the President of Germany, Prof. Dr.
Roman Herzog. A special
commission has been formed for the organization
of the ceremony. Foreign Minister
Pashko, Defense Minister Safet
Zhulali, Minister of Culture Teodor
Laco, the Mayor of Tirana Albert
Brojka, etc. are handling the ceremony.
