Yesterday in the People’s Assembly Approval of the Criminal Procedure Code begins Albania one step clos er to the Council of Europe NJESEI GUI The approval of the Criminal Procedure Code marks an important step toward expanding legal reforms and aligning Albanian legislation with European legislation. Lincime: procedural documentation that regulates in its entirety criminal procedural relations, defining the powers and obligations of state bodies and of the individuals involved in the criminal process. These bodies are, first and foremost, the court, the prosecution, the judicial police, and procedural subjects such as the accused, the injured party, the defense counsel, the expert, and others. The new Criminal Procedure Code came as a necessity of reform in the field of justice. After the broad approval of the new substantive and organizational legislation, and especially of the constitutional one, the shortcomings and provisions of the current Criminal Procedure Code became more apparent. Report from the new session of the Law Commission of the People’s Assembly This code represents a chance and a real opportunity for Albania’s European integration HAJRI SAMATA In a marathon session, the Law Commission of the People’s Assembly began yesterday the article-by-article discussion of the draft Criminal Procedure Code. The code law consists of 463 articles divided into 10 parts and 4 independent sections. As presented in the drafters’ explanatory report, this code aims to solve a series of urgent tasks in a transitional period as a necessity arising from the change of criminal procedures in the country, in line with contemporary standards and in conformity with human-rights conventions. During the discussion, it was pointed out that this code definitively closes the old procedures of investigation and trial and creates new possibilities for strengthening the court’s impartiality and enhancing the role of the defense. It was emphasized that the code is an important instrument for guaranteeing fundamental human freedoms and rights. The discussion covered issues related to the procedural position of the accused, the powers of the prosecution, the role of the judicial police, guarantees in the preliminary investigation phase, and relations with the court. It was assessed that this draft is a major step forward in bringing our legislation closer to European legislation. (continued on page 2)

The first phase of the joint Albanian - American exercise “MEDCEUR-95/1” After four days of military maneuvers under the code name “MEDCEUR-95/1,” the closing ceremony of this activity was held in the premises of Unit 1310. Senior officials of the Ministry of Defense and the Armed Forces, as well as American and Albanian military personnel, took part. On this occasion, Minister of Defense Safet Zhulali gave highly positive assessments of the results achieved in this exercise, which, according to him, is further proof of the good relations between the two countries and our two armies. He said that exercises like these help increase professionalism and strengthen cooperation in areas of mutual interest.
