Alush Dragoshi at the Plenum of the
Court of Cassation
An hour before the decision of the
Court of Cassation in the extraordinary
session, which was taking place in the
hall of the Academy of Sciences,
Prosecutor General Alush Dragoshi
presented before the plenum of this
court a series of new facts which made
it clear to the entire public that the
extraordinary session of this Court
was a politically determined attempt.
When facts related to the involvement
in trafficking, prostitution and
procuring of the relatives and senior
officials of Nano's government had
become public in the Albanian press, it
was time for it to reconsider its own
decision taken on 20 July 1998, in which
it had upheld the rulings of the lower
courts, according to which the Chairman
of the Democratic Party
Mr. Sali Berisha was sentenced to
8 days of arrest.
From Mr. Dragoshi's report, several
other new facts were also made known.
The accusation presented in the
material concerned the granting of a
sum in dollars of approximately
USD 3,500,000 in favor of Mr. Brozi,
including his mother-in-law, Mrs. Shqipe
Brozi, on whose behalf around 800,000
dollars were indirectly withdrawn
through a pyramid company.
Also, this material also refers to the
direct involvement of the eldest daughter
of the President of the Court of
Cassation, Vjollca Brozi, in favoring the
withdrawal of these sums. Likewise, the
material also deals with facts about the
movement of a sum of 800,000 dollars
on behalf of other relatives of Mr. Brozi.
According to the Prosecutor General,
these sums are linked to illegal activities
and have been the subject of verification
by prosecutorial authorities.
The Prosecutor General's report also
addressed Mr. Brozi's relations with
foreign nationals, contacts with persons
involved in trafficking, and relations
which cast serious doubt on the impartiality
of the head of the judiciary.
He stressed that the procedure followed
by the Court of Cassation to reopen a
case that had been concluded was in
contradiction with the law and that this
act seriously undermined the authority
of justice.
At the end of his speech, Alush
Dragoshi called for the Plenum not to
become an instrument of political
pressures, but to remain in compliance
with the law and the Constitution. His
speech was received with great interest
by public opinion, as it shed light on a
broad political and financial backdrop
surrounding this case.

At today's court hearing, the procedure
for notifying the decisions taken by the
Court of Cassation was also examined.
According to the Prosecutor General,
some of the decisions had been taken
without properly notifying the parties
and without being correctly reflected in
the file, which made them legally
vulnerable.
He also mentioned 11 requests by Mano,
which, according to him, had been made
in violation of the procedure.
As a result, Nano's case could not be
heard normally and the session was
postponed until September.
