The consensus that has inflamed several banks and lenders, accused of fraud through their speculative activities and of insulting the sensibilities of Albanian individuals and families in order to profit maximally from the irresponsible actions of depositors, has also heated up in Parliament, from which, had they come there, careful views of a process and prudent assessments on the basis of minimum democratic standards would have been calmly resolved. Unfortunately, the Albanian left has speculated most in this case, turning the bankruptcy of several lenders, due to their mistakes and frauds, into a card to play against the government and the parliamentary majority, in an attempt to bill it for the costs of this bankruptcy.
Throughout yesterday, the Albanian parliament debated under unprecedented anxiety the law on the creation of a fund to guarantee citizen creditors in order to compensate their losses from the activity of lending and pyramid firms.
The consensus that has in fact been reached not only on this law but also regarding the compensation process was received with a certain calm and relief by public opinion. During yesterday’s session, Parliament approved by majority vote the law on the compensation fund, and decided to establish a monitoring commission to oversee the functioning of this fund. Through this law, Albanians are given the possibility of compensation for losses in a controlled manner and according to established criteria.

Yesterday, Parliament approved by 80 votes, 2 against and 2 abstentions the law on the creation of the fund for compensating the creditors of the pyramid borrowers.
Article 1
This law aims to put into circulation part of the assets of natural and legal persons who organized fraudulent borrowing schemes, in order to compensate the losses suffered by their creditors.
Article 2
The subjects of this law are natural and legal persons and are determined by decision of the Council of Ministers on the proposal of the Minister of Finance.
Article 3
All actions affecting the circulation of the assets of the subjects of this law are carried out according to the procedure defined in a decision of the Council of Ministers.
Article 4
All actions affecting the circulation of the immovable property of the subjects of this law are carried out according to the procedure defined in the decision of the Council of Ministers.
Article 5
By special law, the government body for the administration of this property will be established.

Government commission for directing the operation

Minister of Finance, Ridvan Bode, on the law on the distribution of money
In response to the journalist’s question about what is meant by the compensation fund and what the ways are to create it, Minister of Finance Ridvan Bode said that it is a compensatory mechanism to rebuild the financial relations created between the public and the borrowing enterprises.
He explained that the law has sanctioned four forms of compensation: 1. making available to creditors the means and assets of these enterprises; 2. making immovable property available to creditors for ownership and use; 3. compensation with state securities; 4. other possible options.
The minister said that the operation will be directed by a government commission, in which representatives of law-and-order institutions will also take part.
