YESTERDAY AT THE PRESIDIUM OF THE PEOPLE’S ASSEMBLY The Presidium of the People’s Assembly, which met under the chairmanship of Comrade Ramiz Alia on July 31, 1990, approved, among other things, two important decrees serving to further expand and develop the country’s economic cooperation with foreign countries, by applying other, more advanced forms of cooperation and providing the foreign participants in this cooperation with the necessary legal guarantees. The decree “On the protection of foreign investments in the PSR of Albania” states that, within the territory of the PSR of Albania, foreign enterprises, firms or individuals, as well as Albanians residing abroad, may make investments and carry out economic activities connected with them, in accordance with the legislation governing these activities. Foreign investments in the territory of the People’s Socialist Republic of Albania, the decree emphasizes, enjoy full protection and security. These investments shall not be expropriated, nationalized or made subject to any other measure equivalent to expropriation or nationalization, except in special cases for public purposes, and always against payment of appropriate compensation. The decree emphasizes that foreign enterprises, firms or individuals whose investments suffer losses as a result of war, a state of emergency, or natural forces such as earthquakes, floods, etc., shall receive the same treatment as its own enterprises with regard to compensation, indemnities, etc. The People’s Socialist Republic of Albania, it further states, shall make public all laws, rules and procedures relating to or affecting investments. The decree “On the economic activity of enterprises with the participation of foreign capital in the PSR of Albania” states that enterprises with foreign capital participation may carry out economic activity in various sectors of the economy in the PSR of Albania, in accordance with the objectives set out in the current and long-term development plans for the country’s economy. These enterprises, the decree states, are intended to modernize existing facilities or establish new ones using advanced technology, based on the extraction and processing of the country’s raw materials; to increase exports or reduce imports; to expand the range of consumer goods; to create new jobs; and to introduce modern methods of organizing and managing production and services, etc. The enterprise’s economic activity and the investments made in it by foreign persons are protected by the state, which guarantees them conditions equal to those of Albanian legal entities. The decree states that the enterprise is self-financing in lek and foreign currency and opens a foreign-currency account at the Bank of the Albanian State, which may also be opened at a foreign bank by agreement with the Bank of the Albanian State. The foreign person has the right to transfer their share of the profits abroad. The decree states that the enterprise has the right to obtain loans in foreign currency from the Bank of the Albanian State. It may also obtain such a loan from Albanian State. The decree also emphasizes that the enterprise is required to keep accounts in accordance with the rules established by the competent Albanian state bodies. Each year, at the request of the competent tax authorities, it shall provide information on its accounting and economic activity. At this meeting, the Presidium also approved the decree “On meetings, gatherings and demonstrations by citizens in public places.” This decree implements Article 53 of the Constitution, which provides for citizens’ right to hold public meetings, gatherings and demonstrations. The decree also stipulates that gatherings, meetings or demonstrations are prohibited when they include calls for rebellion against the constitutional order, calls to commit criminal acts or violate the law, or attempts to damage relations with other states. The decree emphasizes that participants in these activities are prohibited from carrying weapons, as well as slogans, emblems, symbols and other visual materials with anti-people, fascist or racist content, or that incite national hatred. It also establishes the rules for dispersing these activities in public places when they are held in violation of this decree or the legislation in force. The provisions set out in this decree are intended to ensure that meetings, gatherings and demonstrations in public places take place in accordance with the law. The decree allows the above activities to be held only after their organizers have given prior notice to the competent state body. This notice must state the purpose of the activity, the number of participants, the time, the venue where it will take place, etc. The decree also provides for sanctions against persons who violate the rules set out in it. The above decrees will be published in the next issue of the “Official Gazette.” Also, at the same meeting, the Presidium of the whose foundations include the extraction and processing of the country's raw materials, increasing exports or reducing imports, expanding the range of consumer goods, creating new jobs, introducing modern methods for to those of Albanian legal entities. The decree also states that authorization to conclude a contract or amend it is granted by the Council of Ministers of the People's Socialist Republic of Albania, at the request of the Albanian legal entity, through the ministry responsible for the sector in which the enterprise will operate. In the banking sector, authorization is granted by the Albanian State Bank. The decree states that the application for authorization must include the name of the enterprise, the purpose of its activity, information relating to the foreign persons, the enterprise's purpose of activity, its entities and forms, and a complete study including a technical and economic analysis of the enterprise's activity, etc. Authorization is issued for a period of up to 10 years; the application must specify the extension of the activity, the number of workers, the period, the place where it will be carried out, violate the rules established therein. The above-mentioned the People's Assembly of the PSRA decided to submit to the 8th Session of the 11th Legislature of the People's Assembly a proposal to establish a Special Commission to examine the need for changes to the existing Constitution, and to determine how and when to make the corrections or additions required in it, in keeping with the developments that have taken place in our country from 1976, when the Constitution was approved, to the present day. Finally, the Presidium of the People's Assembly decided to establish a special commission to prepare the law «On Elections to the People's Assembly», for submission People's Assembly for consideration and approval. political task to provide the rural and urban population ever more adequately with milk, meat, eggs and other livestock products.” “The three years that have passed since the decision of the 3rd Plenum,” says Fori Palloci, a specialist in the agriculture section of the Executive Committee of the district KP of Korçë, “show positive progress. This is seen first of all in milk production, where the targets set for the designated herd have been met and exceeded. Likewise, for several years in a row we have met and exceeded the egg-production plan. The weakest link, and therefore the most difficult to overcome, has been meat production. The decision of the 3rd Plenum found us at unsatisfactory levels, as a result of a poor feeding practices. After the plenum, meat-production targets were followed step by step, and improvements became apparent. But we made serious progress especially this year, following the detailed analysis of the problem conducted in February by the district Party bureau. Although only a little more than the first half of the year has passed, we can say that there will be a turnaround in meat production, giving concrete effect to what the 3rd Plenum called for. “What is the turnaround based on, after so many years of failing to meet targets? Among other things, fattening teams have been established alongside every sector at all agricultural enterprises. For three consecutive months before delivery, all animals—cows, oxen, etc.—go through a fattening process. “At the meat-and-dairy enterprise, a new fattening unit has been established this unit. The work carried out at this agricultural enterprise by the fattening teams, as well as the work done in the new unit of the meat-and-dairy enterprise, will bring a significant increase not only in meat production but also in its quality. In previous years, as much as 2,500 quintals of third-quality meat were delivered. One factor that will contribute to positive results in meat production across the district is the good work being carried out at the cattle-raising enterprise. Whereas last year this enterprise, with very specific production targets, was operating at 65 percent of its capacity, this year it is fully equipped, at 100 percent, with the necessary number of calves. In the six-month period alone... [text interrupted] “Interest in pigs has also increased, with pig farming being taken up by agricultural enterprises. The Vreshtas NB and the meat-and-dairy enterprise are both meeting their targets well in pig-meat production. The annual forecast is to produce up to 40 percent more pork than a year ago. This year, poultry production for meat also began. A short time ago, the first 500 quintals were delivered to the city’s retail network. It is expected that a total of 1,000 quintals of chicken will be produced this year. Next year this quantity will rise to 2,500 quintals, which will help improve supplies for the city’s residents. Yesterday, Julli A. Kivcinski, Deputy Minister of Foreign Affairs of the Union of Soviet Socialist Republics, left Albania. EDITORIAL NOTE For several days, our editorial office has been running the column “From decisions to implementation.” In its articles, we have mainly tried to draw attention to the work carried out to implement the decisions of the 9th, 10th and 11th plenums of the Party’s Central Committee. Since these decisions are based on the vital issue of further revolutionizing and democratizing every aspect of the country’s life, from time to time we will return to the important tasks set out by these plenums, publishing letters, observations and various articles about the experience gained and the shortcomings observed in the work of Party organizations, state and economic bodies, enterprises and agricultural cooperatives. The point is for every task, everywhere, to be planned and monitored as it is implemented, for people to be mobilized, for leaders to be more actively engaged, and for every decision to be put into effect. With this note, we wish to draw attention to the fact that, as always, the Party’s decisions and directives form a unity with one another. Very important tasks were also set by earlier plenums of the Party’s Central Committee. It is enough to recall the 3rd Plenum, with its important decisions and measures for radically improving the people’s supply, and the 5th Plenum, which called for our entire culture to be raised to a new qualitative level, etc. The tasks set to increase exports and to strengthen the role of transport in the smooth operation of all branches of the economy, among others, are and will remain especially important. Therefore, in this column we intend to return from time to time to the decisions of these plenums as well, and write about the work carried out by Party committees and executive committees in the districts, ministries, enterprise directorates and cooperative presidiums, highlighting experience that has been developed, responses to shortcomings brought under criticism, and exposing shortcomings and formalistic work, manifestations of bureaucratism and paperwork; and to further encourage the solicitation of the masses’ views, so that they can speak out strongly on every issue, including through “The People’s Voice.”
