A CONSTITUTION SHOULD ENSHRINE, NOT SANCTION, DEMOCRATIC VICTORIES
The draft Constitution is an expression of the people's will for genuine democracy. It must guarantee fundamental rights and freedoms, political pluralism, the rule of law and the sovereignty of the citizen. Public discussions have stressed that the new Constitution must not be a step backward, but a step forward on the path of democracy. Criticism has been raised about unclear wording, the lack of sufficient legal safeguards and the need to define clearly the relations between the branches of power. A demand has been made to remove the article on the leading role of the party and to ensure that sovereignty derives solely from the people. The debate has also centered on issues of property, free economic initiative and human rights. Many participants have stressed that without free elections, without a free press and without independent organizations, democracy cannot be complete. The Constitution must enshrine democratic victories and not restrict them with ideological formulas or provisions that leave room for arbitrary interpretation. It is necessary for the text to reflect society's aspirations for change, accountability of power and equality before the law.
