PROLOGUE FOR PURGES BY LAW
The lowering of professional criteria is the next pretext
(Article by Dr. Arben Puto)
Your Excellency, professor of constitutional law, we clarify that within the framework of this law it will be the relevant administrative body itself that will be able to determine whether a person has or has not been involved in such activity. This is an extremely broad concept and, in practice, very difficult to limit. What does it mean to have been a "leader of political repression"? There is no clear definition of which actions or functions are included in this notion.
The draft law in question has a number of serious flaws. Not only does it run counter to fundamental principles of the rule of law, it also opens the door to administrative arbitrariness. It may serve as an instrument for dismissals from work, not on the basis of proven guilt, but on political and ideological labels. This makes it a dangerous tool for purges by law.
In any democratic society, responsibility is individual. Entire categories of people cannot be punished because of the positions they have held, without concrete acts being proven and without due legal process. Otherwise, the law becomes an instrument of political revenge.

SHOULD THE LAW CRUMBLE, Mr. President?
VERGJUSI
Mr. President
Parliament has just approved by majority vote a decision [...] which it called a law. In reality, it is an act with serious political and social consequences. It affects the fundamental rights of citizens, undermines equality before the law, and opens the way to unacceptable distinctions.
For this very reason, it is up to you to examine it with the highest responsibility and, if you judge that it runs counter to the constitutional spirit, not to promulgate it.
