ALBANIAN JUSTICE BEFORE A GREAT TEST

Which road will it choose: The honor of justice or the shame of politically ordered smear campaigns? The Nano file in the hands of Agim Bendo[s?] — Will he keep his eyes fixed on the procedures of Albanian criminal justice? — Will he disregard the order of the prosecution conducting the investigation, or will he apply the law? — Will the fear of the judges of Tirana bring the first anguish of the farce? In these days, filled with political and legal statements and counterstatements, it is becoming increasingly clear that the "Nano" case has already gone beyond the limits of an ordinary criminal proceeding. It has turned into a major test for Albanian justice itself, for its independence, for its ability to resist political orders, and for the moral integrity of those who wear the robe. The fundamental question raised today is simple: will the court follow the path of the law, or will it become an instrument of a prearranged scenario for the final denigration of Fatos Nano? The file has passed into the hands of Judge Agim Bendo[s?], and with this transfer the burden of responsibility has entered a new phase. If the judge accepts to move along the tracks of prejudice and orders, then Albanian justice will take on a serious stain that will not be easy to wash away. If, on the contrary, it relies on procedure, evidence and the right of defense, then it will have rendered a service not only to the accused, but to the country’s legal order. The issue is not merely personal. It touches the relationship between politics and justice, the limits of executive influence, the role of the prosecution, and the weight of public opinion. Therefore, every step taken in this process will be read as a signal for the future of the rule of law in Albania. Today, when the country needs institutions that earn trust and not punitive farce, the hope remains that justice will choose honor. (continued on page 4)
