THE TRIAL ON THE SECOND DAY, STILL NOTHING! ...

- Because Blorim Çela, the Prosecutor's Office, and the Democratic Party started from nothing as well - The father of the experiment — a companion in the indictment The second day of the trial that is examining the lawsuit brought in Kavajë, against the poet Sokol Paloka, publisher and distributor of leaflets against orgies and hooligans, was also held. By the end of the trial, since it begins late and ends unfinished, there is time for listeners and observers to sit in a hall where questions flow, gather and spread in order to fabricate an unlawful accusation for an unlawful accusation. The court panel stood out from the very first day for its lack of calm, for procedural interference, for bias in favor of the plaintiff, and for frequent use of the words “go ahead” and “not allowed”. In this session, besides hearing witnesses who brought no new evidence, it was seen once again that the accusation brought against Blorim Çela is not based on facts but on assumptions and political interpretations. Many citizens were also present in the hall, among them journalists and representatives of political parties. Throughout the whole time an oppressive atmosphere was created, one that serves neither justice nor the clarification of the truth. San Mikako [?] managed through the procedural twists and turns, giving the impression that the decision had already been prepared. This is further reinforced by the way witnesses are questioned and the defense is interrupted. Repeatedly, leaflets, pamphlets, statements and testimony were mentioned, but no convincing proof was again presented for the charges brought. The defense rightly objected to such a practice. Under these conditions, the second day of the trial ends without bringing anything new. And the overall impression is that an unsupported accusation is being kept alive at all costs. The request for the testimony of the witnesses was not made by us Lawyer Agim Tirana In continuation of this matter, we need to clarify that the request for the appearance of certain witnesses was not made by the defense, but by the other side. This must be clearly recorded so that no misunderstandings are created before public opinion. Likewise, we oppose the way in which some statements made in the courtroom are being interpreted, since they are being used out of context. The defense has requested only the correct implementation of procedure and respect for the rights of the accused. (Continues on page 5)

From the testimony of Aleks Luarasi and Gjergji Sauli before the court panel With anger and bitterness from 1990 in mind, pushed and spat upon by the designated media, today's testimony once again showed how public television has been used for propagandistic purposes. Aleks Luarasi stressed that in some cases the materials were broadcast in truncated form, without giving the public the full picture of the events. Gjergji Sauli also stated that the way developments were presented had been one-sided and often contrary to the facts verified on the ground. According to them, essential elements were omitted and secondary episodes were deliberately emphasized in order to create a false perception. They asked the court panel to bear in mind the role of distorted information in creating an atmosphere against the defendants. (Continues on page 5)

The proceedings against journalists and publishers, as well as the climate of intimidation, seem to us incompatible with international standards. We call on the Albanian authorities to respect freedom of expression, not to use criminal laws to restrict political criticism, and to ensure that the courts act impartially.
