Even in the absurd Socialist complaint of the accusation of “abuse of office” and “appropriation of state property,” the sentence for Fatos Nano is ultimately unlikely to exceed even zero years in prison. This can be confirmed by any experienced jurist and above all by someone with sufficient knowledge of decision 5306 of the Criminal Panel of the Court of Cassation, a decision which from the outset rejected one of the main accusations brought against Nano, that of illegal benefits in the amount of 2 million 600 thousand lek. Thus only one accusation without an accusation remains, and even if the first-instance court were to consider it true, the punishment for it cannot be imprisonment. In our view, the articles used for “abuse of office” concern public officials. Not only that, but this article used by the prosecution against Fatos Nano was also unsuitable for representatives of the state apparatus. In Nano’s case, this accusation falls apart at birth. If we add that when the first sentence of 12 years was handed down, Fatos Nano did not lead any sector or economic activity, but was chairman of an opposition party, the absurdity reaches its peak. It is no coincidence that in most trials held in the world, political sentences are decided in advance by power and only then is the legal procedure dressed around them. From a legal standpoint, his conviction as chairman of the Socialist Party can be remembered as one of the greatest paradoxes of recent years. It is not yet known what sentencing request the prosecution will make, but it will likely try to preserve the earlier decision and invent new political constructs. In today’s courtroom, a confrontation is expected not only between the lawyers and the prosecution, but also between legal reasoning and political orders.
