For Mr. Berisha and his party clique, the “Nano case” was closed by the decision of the Court of Cassation. For the Socialist Party, the “Nano case” remains open. But its leaders firmly declare that the era of dictatorship and dictators in Albania is over once and for all, and that the “PS” is neither frightened nor deterred from the struggle to establish a truly democratic Albania, with a market economy, political pluralism and the rule of law. To avoid going on at length, the polarization provoked by the DP between itself and its regime on the one hand, and the “PS” and the other opposition forces on the other, brings into the political arena a series of diametrically opposed positions on the independence of the judiciary, the adoption of the constitution, early elections and a new political choice, economic reform, privatization, human freedoms and rights, local government, responsibility for the worsening situation and political stability, and other issues. But let us get to the heart of the matter: Who emerged victorious from the dispute over the “Nano case”? Without a doubt, Fatos Nano and his Socialist Party emerged victorious. Why? Because, despite being sentenced by three levels of the judiciary, Fatos Nano won the trial politically, morally and, why not, also legally, on the basis of irrefutable evidence and countless facts that proved the accused’s innocence. No honest Albanian was convinced of Nano’s guilt, despite the deafening, coercive, deceptive, arrogant, threatening, instrumentalized, etc. propaganda of the Democratic Party. Meanwhile, PS members and supporters feel proud of their leader’s manly stance as a true patriot and democrat against “democratatorship,” for real pluralism against pseudo-pluralism, for understanding and social peace among Albanians against political revenge and revanchism, for an independent justice system against [text cuts off]. Under the aforementioned law, “the lawyer has the right to meet alone and without any restriction with his client who is detained, arrested or imprisoned.” But does the prison command know the law? This is best confirmed by the fact that since 28.7.1994 none of the lawyers has been allowed to meet with Fatos Nano. As for his family and relatives, there can be no question of a visit. He is currently under conditions of extreme police isolation. Although he is now a convicted prisoner, he continues to be held alone in cell 47, as he has been for a year, since he has been considered a dangerous element. He has no opportunity to communicate with anyone except the people in blue who serve near him. The sun’s rays cannot enter because the window opening is only about 26 centimeters wide. He sleeps without sheets or pillows on a so-called mattress laid on the cell floor. The legislator who provided for lawyers’ meetings with detainees and prisoners also provided for the observance of a series of rights guaranteed to them by law, both before and after they are found guilty by a court. It is essential that prison staff know these rights and guarantee them to detainees and prisoners. The same attitude toward Fatos Nano is also being taken by the Court of Cassation. Another indisputable fact is that, to this day, the court’s decision has still not arrived at Tirana prison. It would have been better if it had been sent to the Prison Command as quickly as it was sent to Television and Radio, because then the interests of today’s state would be valued equally with those of the individual. Mr. Brozi informed us that “we’ll get it from the district court,” but he did not say when. Surely after a few more days have passed. It matters little to him that Fatos Nano has been kept in isolation for over a year. Surely Mr. Brozi and others such as the so-called Albanian Helsinki Committee for the protection of human rights are unaware of the conditions of isolation in Tirana prison, although they have been continuously covered in the press. With such actions and attitudes, one cannot represent oneself with dignity before the world in the field of human rights protection, especially when public opinion is so sensitive at present.
