A JUST LAW CANNOT BE ADOPTED BY VIOLATING THE CONSTITUTIONAL LAW

TODAY THE LAW ON REFERENDUMS WILL BE DISCUSSED IN PARLIAMENT UNDER AN ACCELERATED PROCEDURE Why the socialist group voted against The President called the PD national activist meeting in lhos[?] After yesterday's session, during which parliament approved the severance of deputies from their workplace and it was said[?] that it was decided that today the law on referendums would be discussed under an accelerated procedure, the 42 socialist deputies have drawn up this statement, which, we believe, clearly presents their political position. Here is its text: 1. All matters concerning the constitutionality of the decisions and laws issued by the People's Parliament fall within the exclusive competence of the Constitutional Court, and therefore debate and a decision in Parliament on this issue diminish and exceed the powers of the Constitutional Court. 2. The People's Parliament is the highest organ of state power and has the right to determine its own working procedure. Since it decided to conduct the review of the law on referendums under an accelerated procedure, without first distributing the bill and the accompanying report to the deputies, the deputies' ability to become acquainted with the draft and to express their position in a reasoned manner was seriously impaired. 3. Constitutional Act No. 7491, dated 29.4.1991, “On the Main Constitutional Provisions,” stipulates in Article 16 that the deputy's workplace is preserved. Yesterday's decision to detach deputies from their workplace was taken without first clarifying the financial, organizational and legal bases for its implementation. 4. The law on referendums, by its nature, directly affects the exercise of popular sovereignty. For this reason, it requires broad, calm and reasoned discussion, not hasty approval. A just law cannot be adopted by violating the constitutional law. 5. The President called the PD national activist meeting in lhos[?], which constitutes an inappropriate interference in institutional debate and in the country's pluralistic political life.

THE TRICKERY KNOWN AS REFERENDUM

Yesterday's session of 5 June, the first in this parliament's marathon session, brought no major difference; it only reinforced citizens' own conviction that a quick solution to the country's current political and economic crisis is necessary. In terms of form, yesterday's session was dominated by the rhetoric of political statements, despite the fact that all parliamentary forces had agreed on a packed agenda that included discussion of the law on referendums, the status of the deputy, as well as several other urgent matters. In fact, not the opposition forces, but the Socialist Party, which had just received the mandate to govern, appeared to be the most interested in dragging out and keeping the political debate alive. There were many accusations and counter-accusations, long procedural interventions, and attempts to delay consideration of the draft law. This was also clearly seen in the way the referendum issue was handled. The draft law in question was presented as a necessity to ask the people about fundamental issues. But the rushed manner, the artificially created climate, and the political use of this topic arouse the suspicion that we are dealing with a trickery known as referendum. Instead of serving to give citizens a voice, this initiative risks being used as a means of pressure on institutions and as a propaganda weapon in the party struggle. In the conditions of a deep economic crisis, when the country is experiencing severe shortages, a human exodus and general insecurity, parliament should have focused on emergency measures and stability. The referendum cannot be used as a smoke screen to avoid the concrete responsibilities of governance. (Continued on page 4)
