Interview with Fatos Nano’s lawyer, Agim Tirana Yes. With Decree No. 1155, dated 3.5.1995, Law No. 7893, dated 27.1.1995, “On the Pardon of Sentences,” entered into force, according to which those sentenced to up to 8 months in prison for the offense of non-payment of maintenance and up to 3 years for other offenses, provided that no prison sentence has been imposed for criminal acts committed intentionally, benefit from a pardon of sentence. According to Article 2, or more precisely, the criminal offense and the prison sentence of 2 years and 6 months for Mr. Fatos Nano fall under this law. For this reason, it appears that by a special decision of the People’s Assembly in 1993, it was made impossible for Mr. Nano to be included in this amnesty law. Nevertheless, the issue of his amnesty was repeatedly raised by the defense. The request of the chairman of the PS parliamentary group, Servet Pëllumbi, and of MP Fatmir Xhafa, for his inclusion in this law, was not taken into consideration. Instead, it was requested that the case be reviewed through judicial channels. This is also why today attention is focused on the trial in the Court of Cassation. On the other hand, it has been made known that the defense has put forward numerous grounds for the invalidity of the previous decisions and for serious procedural violations during the investigation and trial. Lawyer Agim Tirana emphasizes that precisely the mechanism that drags out the рассмотрение of the case is the very same one that served to put him in prison as well. The interview raises questions about the role of the justice bodies, the way evidence was handled, and the political motivation of the process. According to him, the decisions taken earlier cannot withstand legal analysis, and their overturning is only a matter of time. (Continued on page 3)

The Albanian Helsinki Committee, in Paris, expresses approval of the French government’s decision to grant political asylum to Mr. Ylli Bufi, deputy chairman of the Socialist Party of Albania. The decision is regarded as an act of importance for the protection of human rights and as a signal of respect for democratic standards. The reasons put forward for the procedure resemble formal justifications, while in essence the case clearly has a political charge. Instead of justice speaking clearly, one obstacle after another is created. In this context, the irony of the title is linked to the fact that politics is dealing with the “text,” that is, with examination, with the word, and with the very meaning of justice.
