The Constitutional Court in crisis
Yesterday at the Constitutional Court, Rusten Gila declared the laws “amnjenoacid” [?] and “on the verification of figures” constitutional
.
The Constitutional Court is not in a position to decide by majority on the issues assigned to it by competence and on which it is required to pronounce itself; it should have done so.
The declaration of the law as constitutional, in the event that the Court decided by a 6 to 3 vote against, placed it in competition with the issues assigned to it by competence and on which it is required to pronounce itself. I

Three months ago the social democrats, Trusni, Milo, Apostoli and the socialists Doko, Abdi Baleta, strongly ideological and independent of the constitution, stressed the need for the “de-communization law”. Great importance was attached to the fact that the “lustration law” on 30 October ’95, 10 November ’95, and 17 January ’96 should be a decision, but nothing of the sort was done, passing into secrecy, after threats against members from anonymous authors and the Official Gazette. Many in opposition political circles have, after this, bloody orders of “dragging on” further, helped by the Constitutional Court.

It is understood that such a delayed but necessary move avoided a conflict over the rules for the new elections. This postponement has come from differing positions among the commission members, but also under the influence of remarks expressed by various political and social factors in the country.
