OSCE Head of Mission, Danish Foreign Minister Niels Helveg Petersen responds In a statement in Tirana, my Personal Representative in Albania, serving as Head of the OSCE Mission, former Chancellor of Austria Franz Vranitzky, has emphasized the responsibility of Albania’s political parties to create the conditions for holding Parliamentary elections. Failure to reach an agreement under these conditions, he notes, will lead the OSCE and others to reconsider their commitment to help Albania overcome the country’s current crisis. I fully support Dr. Vranitzky’s position. I also urge the political parties and President Berisha in particular to reach an agreement as a matter of urgency on the terms of an applicable law for Parliamentary elections, and to establish a climate in which preparations for free and fair elections can be properly undertaken.

Asked by our editor about the electoral law adopted by the DP, the Chairman of the PSSH Legal Commission, Dr. Fehmi Abdiu, made the following statement: Having familiarized ourselves with the law adopted by the DP, I can preliminarily state that the law drafted by Arbnori - Spahia is more antidemocratic and more unconstitutional than the 1996 law. This law conflicts with the Constitutional Provisions, since it gives the President of the Republic full powers to appoint and designate the Central Election Commission, and to appoint the chairpersons and deputy chairpersons of constituency commissions. It creates the possibility for the Democratic Party and him to always have a majority on the commissions and manipulate the vote; it denies the right to vote to some citizens who are detained, arrested, or imprisoned, even though under the Constitutional Law they should enjoy this right. This law does not establish the procedures for setting up the central, constituency, and polling-station commissions. It deliberately leaves undefined the powers of each member of the Presidium, the chairperson, deputy chairperson, and Secretary, and does not establish the criteria for political forces to participate with members on these commissions. The law contains conflicting provisions that contradict one another, and numerous other irregularities will create opportunities for the Democratic Party, using the organized forces it deployed last year, to try to manipulate the elections again. In recent days, the Socialist Party has presented detailed and professional official positions on this issue to international organizations, and it has not ruled out the possibility of bringing this law before the Constitutional Court and other international bodies that examine such constitutional matters.
