The unspoken word - Melani's expression

BY ALEKSANDËR PIPA Here the question is raised whether any diplomatic relationship with foreigners, etc., taking into account the interests of Albania and Albanians, in itself constitutes a punishable act such as national treason. I think the issue can be posed in two ways. First, with the principle of the presumption of innocence, according to which ViIliam Martin Melani cannot be called guilty without the guilt being proven. On the other hand, the thesis of applying a double standard is a step toward a diplomacy of cunning and trickery, to its own detriment and illogicality. In this work, exclusion places and permanently every kind of alliance with anti-Albanian political action and with the interests of the nation. It is equally nonsensical to base it on the act and the inclusive lure of them with the inevitable outcome of reconciling them in an independent Albania. We are a small country and this should make us more attentive to legal phenomena and to solving them. In any case, the argument replaces personal guilt with the foreign name that takes its place. Even if it is granted to foreigners, the act is still punishable under Albanian law. This is because treason is always committed to the detriment of the country and its citizens. As far as this is concerned, it is important that Mr. Berisha has placed the matter under Albanian jurisdiction. Under our laws, cooperation with foreigners does not constitute treason provided that such cooperation is not to the detriment of the country's independence and interests. If in the present case there was such a connection with foreigners, the person may be accused under Albanian law on the grounds of national treason. Otherwise, this would mean that treason does not differ and was never distinguished under a double standard for our country. If Melani cooperated with foreign services to the detriment of Albania, then he should be judged to have acted against it. As for the precedent of the case, it also remains clear that under Albanian law, the accusation of national treason does not simply include cooperation with foreigners, but only that which is to the detriment of the country and Albanian citizens in a foreign interest. If such a text of NGOs [?], which has to do with the real consultation of the automatic national steering of the government, is also punishable under Albanian law. Therefore it must be borne in mind that the actions and beliefs of the individual cannot always serve as a general basis for criminal accusation. page 2

A group of vandal [young people] who burned the flag and tried to break into the Prime Minister's office were the cause of the incidents. The President of the United States and Secretary of State Madeleine Albright, as well as other representatives of the American government, have been following the situation in Albania closely. On behalf of the American government, Ambassador Joseph Limprecht said yesterday that the problem can be solved by peaceful means, not violence. He underlined that the U.S. supports democracy and the rule of law in Albania.
